These Terms of Service (“Terms”) govern your use of rackable-pallets.com and any quote, order, or business transaction with Rackable Pallets (“we,” “us,” “our”). By using the site, requesting a quote, or placing an order you accept these Terms. If you don’t agree, please don’t use the site.
1. About us
Rackable Pallets is a distributor and reseller of new, used, refurbished, and made-to-order plastic bulk containers, pallet packs, hopper-bottom seed boxes, and pallets. We carry products from manufacturers including Buckhorn, Orbis, DuraGreen, Monoflo, Ropak, Uni-Pak, Macro Plastics, ALPAL, Refurbest, and Shuert Technologies. For most items the manufacturer’s warranty (if any) flows through to you; we do not manufacture the products ourselves.
2. Eligibility
This site is intended for business customers age 18 or older. By using the site you represent that you have the authority to enter into a binding agreement on behalf of yourself or the company you represent.
3. Site content and intellectual property
All content on this site — including page text, photos, product descriptions, specifications, the Rackable Pallets logo, and the site’s look and feel — is owned by Rackable Pallets or licensed from manufacturers and suppliers. Brand names (Buckhorn, Orbis, DuraGreen, Monoflo, Ropak, Uni-Pak, Macro Plastics, ALPAL, Refurbest, Shuert Technologies, and others) are the property of their respective owners and appear here only to identify the products we resell.
You may not copy, scrape, republish, or use site content for commercial purposes without our prior written permission. Personal, non-commercial use (e.g., saving a product page for reference) is fine.
4. Quotes, pricing, and product information
- Quotes are valid for 30 days from issuance unless we tell you otherwise in writing.
- Prices on the site are quoted in U.S. dollars and may change without notice. The price that applies to an order is the one confirmed on your order confirmation, not the price displayed on the site at any earlier time.
- Unless we say otherwise, prices do not include freight, lift-gate, residential, inside-delivery, or accessorial charges. Freight is quoted separately based on destination and equipment.
- Photos, dimensions, weights, capacities, and material specifications are taken from manufacturer data and are accurate to the best of our knowledge. Verify critical specifications before ordering — especially internal dimensions, racking compatibility, and food-grade or hazmat ratings.
- Used and refurbished products vary lot-to-lot in color, surface wear, and minor repairs. We disclose this on the product page; please review listings carefully.
- Stock levels and lead times change. If an item becomes unavailable after you order, we will offer a substitute, a delivery delay, or a full refund.
5. Orders and payment
- An order is formed when we send you an order confirmation. Until then, an online order or quote is an offer that we may accept or decline.
- Accepted payment methods include credit card, ACH, wire transfer, and company check. Net terms are available only by prior credit approval.
- Payment in full is required before we release product for shipment, except for approved net-terms accounts.
- Late payments on net-terms accounts may accrue a service charge of 1.5% per month (or the maximum allowed by law, whichever is lower) and may result in a hold on future orders.
- You are responsible for any sales, use, or excise taxes applicable to your purchase, unless you provide a valid resale or exemption certificate before invoicing.
6. Shipping and risk of loss
Unless agreed otherwise in writing, all shipments are FOB origin. Title and risk of loss pass to you when the carrier picks the product up at the manufacturer or our warehouse. We arrange freight on your behalf as a convenience; for damage or loss in transit, see the Return Policy for how to file a claim.
Delivery dates are estimates based on manufacturer and carrier schedules. We are not liable for delays caused by carriers, weather, port congestion, manufacturer production schedules, or other circumstances outside our control.
7. Returns
Returns are governed by our Return Policy, which is incorporated into these Terms by reference. In summary: new in-stock items are returnable within 30 days with a restocking fee; used, refurbished, and made-to-order products are generally non-returnable; freight damage must be reported within 48 hours.
8. Warranties
- New manufacturer products carry whatever warranty the manufacturer provides, if any. We pass any applicable manufacturer warranty through to you and will help facilitate warranty claims; we don’t add a separate warranty on top of the manufacturer’s.
- Used and refurbished products are sold AS-IS, with no warranty of any kind beyond what’s described in the product listing.
- To the maximum extent allowed by law, we disclaim all other warranties, express or implied, including the implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
- You are responsible for confirming that a container is appropriate for your specific use, including any food-contact, hazmat, FDA, USDA, or industry-specific requirements.
9. Limitation of liability
To the maximum extent allowed by law, Rackable Pallets is not liable for any indirect, incidental, special, consequential, or punitive damages — including lost profits, lost data, business interruption, or loss of goodwill — arising out of or related to the site, a quote, an order, or use of any product. Our total cumulative liability for any claim related to a product or order is limited to the amount you actually paid Rackable Pallets for the product giving rise to the claim.
Some jurisdictions don’t allow certain disclaimers or limitations. In those jurisdictions our liability is limited to the smallest amount permitted by law.
10. Indemnity
You agree to defend, indemnify, and hold harmless Rackable Pallets, its officers, employees, and suppliers from any claim arising out of your misuse of a product, your violation of these Terms, your violation of any law, or your infringement of any third-party right.
11. Acceptable use of the site
- Don’t scrape, crawl, or harvest data from the site beyond what a normal browser does.
- Don’t attempt to break, probe, or otherwise compromise the site’s security.
- Don’t post or submit anything unlawful, harassing, fraudulent, or infringing.
- Don’t use the site to send spam or any unsolicited commercial communications.
We may suspend or terminate access for any user who violates these Terms.
12. Privacy
Our Privacy Policy describes how we collect, use, and share information. By using the site you also agree to that policy.
13. Third-party links
The site may link to manufacturer pages, specification sheets, or other third-party resources. We don’t control those sites and aren’t responsible for their content or policies. Use them at your own risk.
14. Force majeure
We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including manufacturer production delays, carrier disruptions, severe weather, labor actions, supply-chain shortages, or government actions.
15. Governing law and disputes
These Terms are governed by the laws of the United States and the state in which Rackable Pallets is registered, without regard to conflict-of-laws principles. Disputes will be resolved exclusively in the state and federal courts located in that state, and both parties consent to the personal jurisdiction of those courts.
16. Changes to these Terms
We may update these Terms from time to time. The “Effective date” at the top reflects the most recent revision. Continued use of the site after changes take effect means you accept the updated Terms.
17. Severability and entire agreement
If any provision of these Terms is held unenforceable, the remaining provisions will still apply. These Terms (along with the Privacy Policy and Return Policy) are the entire agreement between you and Rackable Pallets regarding the site and supersede any prior agreements or understandings on the same subject.
